Website Terms and Conditions

These Terms and Conditions govern the purchase and use of burial rights, use of the Taylor Cemetery District website, and participation in the district’s telephone, voice, and text communications programs.

“District,” “we,” “us,” and “our” refer to Taylor Cemetery District.

Part I — Purchase and Use of Burial Rights

Effective January 1, 2026

The purchase of a burial plot from the Taylor Cemetery District conveys only a permissive right of burial, also referred to as a burial right or interment right. The purchase does not convey ownership, title, deeded interest, or any other real property interest in the physical land. Legal title to all cemetery property remains with the Taylor Cemetery District.

By purchasing, receiving, holding, transferring, or using burial rights within the Taylor Cemetery District, the purchaser and any successor, heir, representative, or authorized user agree to comply with all cemetery rules, regulations, policies, procedures, fee schedules, and decisions adopted or administered by the Taylor Cemetery District Board of Cemetery Maintenance Commissioners or its authorized representatives.

Acceptance of burial-right terms does not, by itself, constitute consent to text messages, automated calls, marketing, fundraising communications, or call recording. Communications consent is addressed separately in Part III.

1. Nature of Burial Rights

A burial right grants the holder permission to use a specifically identified burial space for lawful cemetery burial purposes, subject to district policy, cemetery layout, record accuracy, physical site conditions, applicable law, and final approval by the Taylor Cemetery District.

Burial rights are not real estate. They may not be treated as deeded property, subdivided, pledged as collateral, sold for profit, advertised for private sale, or transferred except as permitted by district policy and applicable law.

Issuance of a burial right certificate, receipt, plot ownership document, or similar district record signifies that the district has recognized the purchaser’s right of burial for the identified plot or plots, subject to these terms and conditions. Such documentation does not convey ownership of the land itself.

2. Eligibility, Residency, and Purchase Limits

For purchases occurring on or after January 1, 2021, no more than four burial rights may be purchased per household, unless an exception is approved by the Taylor Cemetery District Board of Cemetery Maintenance Commissioners.

Residents of the Taylor Cemetery District shall be assessed the resident burial right fee established by the district’s current fee schedule. Nonresidents shall be assessed the nonresident burial right fee established by the district’s current fee schedule.

Proof of current residency is the responsibility of the applicant. The district may require documentation sufficient to verify residency, including but not limited to property tax records, utility records, government-issued identification, voter registration, or other documentation acceptable to the district.

Any claimed exception, special circumstance, family arrangement, historical understanding, or board-approved deviation may be documented in the district’s official records or in the notes section of the burial right documentation.

3. Payment and Issuance of Burial Rights

Burial rights are not considered issued, reserved, or finalized until payment has been received in full, required documentation has been completed, and the district has entered the transaction into its official records.

The district may decline, delay, or correct issuance of burial right documents if payment is incomplete, residency status is unclear, plot availability is uncertain, records conflict, or additional review is needed.

A burial right document issued in error, obtained through misrepresentation, or inconsistent with district records may be corrected, amended, suspended, or voided by the district after review.

4. No Private Resale or Straw Purchases

Burial rights may not be privately resold, brokered, advertised, assigned, or transferred to another person or entity for compensation.

Straw purchases are prohibited. A straw purchase occurs when a person purchases burial rights on behalf of another person, household, family, or entity in order to obtain a lower fee, evade purchase limits, avoid residency requirements, reserve plots for undisclosed persons, or otherwise bypass district policy.

If the district determines that a burial right was obtained through a straw purchase, misrepresentation, concealment, fraud, or improper transfer, the district may declare the transaction void, cancel the burial right, refund the amount originally paid if appropriate, and make the plot available for lawful sale or reassignment.

5. Return or Surrender of Burial Rights

A burial right holder who no longer desires to retain a burial right may submit a written request to surrender or sell the burial right back to the Taylor Cemetery District.

The district is not obligated to repurchase burial rights unless required by law or approved by the Board of Cemetery Maintenance Commissioners.

Any repurchase, refund, credit, exchange, or surrender shall be handled at the discretion of the board and documented in the district’s official records.

Unless otherwise approved by the board, any refund or repurchase amount shall not exceed the original amount paid to the district for the burial right.

6. Transfers Upon Death of Burial Right Holder

Upon the death of a burial right holder, the district may recognize the surviving spouse as the successor holder of the burial right, unless the district receives legally sufficient documentation showing otherwise.

If there is no surviving spouse, or upon the death of the surviving spouse, the district may recognize the children of the original burial right holder as the collective successor holders of the burial right, unless legally sufficient documentation shows otherwise.

No automatic recognition of ownership or control shall extend beyond the children of the original burial right holder unless approved by the district or required by applicable law, court order, probate documentation, or other legally sufficient authority.

Where burial rights are jointly held, inherited, or claimed by multiple persons, the district may require written consent from all known persons with a recognized interest before authorizing burial, transfer, surrender, exchange, or other action affecting the burial right.

For purchasers or successors residing outside Idaho, the district will attempt to honor applicable marital property, inheritance, probate, and transfer rules to the extent legally permissible and administratively practical. The district may require documentation from a court, estate representative, attorney, or other reliable source before recognizing a claimed interest.

7. Unclear Ownership, Disputes, and Competing Claims

When ownership, control, succession, or authority over a burial right is unclear, disputed, undocumented, or contested, the Taylor Cemetery District may place a temporary hold on the burial right until the issue is resolved.

The cemetery sexton or other authorized district representative may make an initial administrative determination based on district records, available documentation, family relationship, prior use, apparent intent, and the best interests of the district and affected parties.

A person who disagrees with the initial determination may submit a written appeal to the Taylor Cemetery District Board of Cemetery Maintenance Commissioners. The board may review the matter, request additional documentation, conduct discussion at a properly noticed meeting when required, and issue a final district determination.

If the dispute cannot be resolved administratively, the district may require the parties to obtain a court order, probate order, written settlement agreement, or other legally binding documentation.

The district will honor a valid court order or other legally controlling determination.

The district is not responsible for resolving private family disputes, inheritance conflicts, estate disagreements, or competing claims beyond making reasonable administrative determinations based on available records and applicable law.

8. Recordkeeping, Mapping, and Correction of Errors

The Taylor Cemetery District maintains cemetery records, plot maps, burial records, and burial right documents to the best of its ability. Historical records, older surveys, plot maps, family records, and prior bookkeeping may contain errors, omissions, inconsistencies, or unclear descriptions.

The district reserves the right to correct administrative, clerical, mapping, surveying, numbering, ownership, or bookkeeping errors when discovered.

Corrections may include amending records, clarifying plot descriptions, updating ownership documentation, exchanging burial rights, or relocating unused burial rights to a substantially similar available plot.

If a correction materially affects a purchaser’s unused burial right, the purchaser may request either a full refund of the original purchase price or assignment of alternate burial rights, subject to availability and board approval.

The district shall make reasonable efforts to avoid disturbing existing burials and to preserve the dignity, continuity, and integrity of cemetery records.

9. Compliance With Cemetery Policies

All burials, markers, monuments, decorations, improvements, plantings, maintenance activities, disinterments, cremation placements, and other cemetery uses are subject to district rules and approval.

A burial right holder may not install, alter, remove, assign, transfer, or authorize use of any burial space in a manner inconsistent with district policy.

The district may refuse or delay burial, monument placement, transfer, surrender, or other action if required documentation is missing, ownership is disputed, payment is incomplete, the request violates district policy, or the district determines that additional review is necessary.

10. Invalid Documents and Unauthorized Transactions

Any unauthorized, altered, forged, fraudulent, incomplete, or improperly transferred burial right document may be rejected by the Taylor Cemetery District.

Possession of a burial right certificate, receipt, plot document, family record, or other document does not by itself establish a valid burial right if the document conflicts with official district records or was obtained, altered, transferred, or used improperly.

The district may require original documentation, proof of identity, proof of authority, family relationship documentation, probate records, death certificates, written consents, or legal orders before recognizing a claimed burial right.

11. District Authority and Final Interpretation

The Taylor Cemetery District Board of Cemetery Maintenance Commissioners has authority to interpret, administer, amend, and enforce these terms and conditions, subject to applicable law.

The board may grant exceptions in unusual circumstances when doing so serves the best interests of the district, preserves fairness, protects public cemetery resources, corrects an error, or prevents an unreasonable hardship.

Any exception should be documented in the district’s official records.

12. Practical Administration

The district’s goal is to administer burial rights with fairness, consistency, compassion, common sense, and respect for the deceased, their families, district taxpayers, and the long-term integrity of the cemetery.

Nothing in these terms and conditions prevents the district from seeking legal advice, requiring additional documentation, delaying action pending clarification, or complying with applicable court orders or Idaho law.

Part II — Website Use

Effective date: January 1, 2026

1. Website Information

The district’s website provides information about cemetery services, policies, fees, burial records, and plot availability. We make reasonable efforts to keep this information accurate, but it may contain errors, omissions, or outdated details.

Confirm current fees, availability, burial rights, and service arrangements directly with authorized district staff. Online maps, directories, and availability listings do not establish a burial right or replace the district’s official records and review process.

2. Online Forms and Service Requests

Information submitted through website forms must be accurate. Anyone acting on behalf of another person must have appropriate authority.

Submitting an inquiry, purchase request, burial notification, transfer request, maintenance request, or other form does not by itself reserve a plot, issue burial rights, approve a transfer, authorize work, or confirm a service.

Burial-right purchases remain subject to Part I. Other requests require confirmation from authorized district staff.

Contact district staff directly to confirm time-sensitive arrangements.

3. Acceptable Use

Use the website only for lawful purposes. You must not:

  • Submit false, fraudulent, or misleading information.

  • Impersonate another person or misrepresent your authority.

  • Attempt unauthorized access to the website, its systems, or another person’s information.

  • Interfere with website operation or introduce malicious software.

  • Submit unlawful, threatening, or abusive material through website forms.

4. Information Submitted to the District

Submit only information reasonably necessary to process your request. Do not enter payment card details, Social Security numbers, or other sensitive information into general inquiry fields.

If documentation is required, ask district staff how to provide it.

Information submitted to the district may be subject to applicable public records requirements. Disclosure and confidentiality protections are governed by applicable law.

Additional information about our handling of personal information is available in our Privacy Policy.

5. Third-Party Services

The website may link to outside maps, directories, forms, payment services, or other resources. Those providers may have separate terms and privacy practices.

The district does not control the content, availability, or operation of third-party services.

6. Website Availability

Website features may be temporarily unavailable because of maintenance, technical issues, or circumstances outside the district’s control.

If a form or online service is unavailable, contact the district by telephone or email. Do not rely solely on an online submission for a time-sensitive cemetery arrangement.

7. Relationship to District Policies and Applicable Law

These website-use terms do not alter burial rights, replace adopted cemetery policies, or override applicable agreements or law.

Responsibility for loss, damage, or injury is determined by applicable law and any controlling agreement. Nothing in these terms waives rights or remedies that cannot legally be waived.

8. Updates

The district may update these website-use terms to reflect changes in website features, services, or adopted policies. Revisions will display an updated effective date.

Amendments to burial-right terms remain subject to the district’s authority, applicable law, and controlling agreements. Updating website terms does not expand communications consent.

Part III — Phone, Voice, and Text Communications

Taylor Cemetery District Communications Program
Effective date: January 1, 2026

1. Program Description

Taylor Cemetery District offers telephone, voice, and SMS/MMS text communications about cemetery services. These may include responses to inquiries, burial-right purchase updates, burial scheduling, appointment reminders, document requests, payment notifications, monument permits, maintenance requests, and cemetery notices relevant to your services.

With separate, voluntary consent, the district may also send marketing messages about cemetery services, community event announcements, and fundraising communications.

Communications may be delivered by district staff or authorized service providers acting on the district’s behalf. Where separately authorized, voice calls may use automated dialing, prerecorded messages, artificial voices, or AI-generated voices.

2. Consent and Choice

Consent to receive texts or automated, prerecorded, artificial-voice, or AI-generated calls is collected separately from acceptance of burial-right purchase terms.

Purchasing, inheriting, holding, transferring, or using burial rights; visiting the website; providing a telephone number; or accepting these Terms and Conditions does not, by itself, enroll you in a messaging program or authorize automated voice calls.

Consent applies only to Taylor Cemetery District, the communication methods you select, and the subjects described when you consent. Consent is not transferred to heirs, relatives, or other persons.

Marketing and fundraising communications require a separate affirmative opt-in and express written consent under this program. Consent is voluntary and is not a condition of purchasing burial rights, receiving cemetery services, or making a donation.

If you initiate a text conversation, the district may respond to that inquiry. Your inquiry alone does not enroll you in recurring messages or marketing communications.

The district maintains records of communications consent and withdrawal as required by applicable requirements.

3. Frequency and Charges

Message and call frequency varies based on your requests, service arrangements, and the programs you choose. Opted-in programs may include recurring communications.

Message and data rates may apply.

Your telephone provider’s standard voice, messaging, and data charges may apply. Contact your provider for details about your plan.

4. Stop Text Messages

Reply STOP to any district program text message to unsubscribe.

Other standard opt-out keywords, including CANCEL, END, QUIT, REVOKE, OPTOUT, and UNSUBSCRIBE, and other clear requests to stop messages will also be honored.

You may receive one final text confirming your unsubscribe request. No further program texts will be sent unless you subsequently provide new express written consent.

You may also withdraw consent by calling 208-557-9909, emailing info@taylorcemetery.com, or contacting district staff.

5. Stop Calls or Withdraw Other Consent

To stop optional calls, automated calls, prerecorded calls, or AI-generated calls, tell the district representative during a call, use the opt-out instructions provided in an automated call, call 208-557-9909, or email info@taylorcemetery.com.

The district will honor clear requests to withdraw consent in accordance with applicable requirements. A request to stop all calls and texts will apply to both.

Withdrawing communications consent does not cancel your burial rights or cemetery arrangements. Contact district staff to arrange an alternative means of communication for ongoing services.

6. Help and Support

Reply HELP to a district program text message for assistance.

For additional support:

7. Telephone and Automated Voice Calls

The district will identify itself and the purpose of its outbound calls and use accurate caller identification.

Automated, prerecorded, artificial-voice, and AI-generated calls will be made only with the required prior consent. Marketing and fundraising calls under this program require separate express written consent.

When an automated or AI voice is used, the district will disclose that fact at the beginning of the interaction.

Applicable calling-hour restrictions, do-not-call requirements, and requests to stop calls will be honored. Automated calls will provide applicable opt-out instructions.

8. Call Recording and Consent

All telephone calls with Taylor Cemetery District are recorded for quality assurance and training, subject to required notice and consent.

At the beginning of each call, the district will inform all participants that the call will be recorded and obtain their consent before recording begins. Acceptance of these Terms and Conditions does not itself constitute consent to recording a particular call.

If you do not consent to recording, the telephone conversation will not proceed. You may instead contact the district at info@taylorcemetery.com or through our Contact page.

If another participant joins a call, the district will provide notice and obtain that participant’s consent before recording their participation.

Recordings are handled in accordance with the district’s Privacy Policy and applicable law.

9. Privacy and Mobile Information

The district uses contact information, communication preferences, consent records, and communications content to provide the programs you select and administer cemetery services.

Mobile information will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be sold, rented, or transferred to another organization for its own messaging programs.

Service providers, including communications platforms and carriers, may process information only as needed to provide services on the district’s behalf. Disclosures required by law remain subject to applicable legal requirements.

See our Privacy Policy for additional information.

10. Delivery and Time-Sensitive Arrangements

Messages and calls may be delayed, blocked, or undelivered because of carrier service, network conditions, device settings, or other technical circumstances.

Carriers are not liable for any delayed or undelivered messages.

A text or voicemail does not by itself confirm a burial, finalize a burial-right purchase, authorize a transfer, or approve a monument installation.

Confirm time-sensitive arrangements directly with authorized district staff.

11. Telephone Number Changes

Provide a number you are authorized to use and notify the district if it changes or is reassigned.

Another person’s consent does not authorize communications to you. If you receive a district message intended for a previous holder of your number, reply STOP or contact district staff.

12. Relationship to Burial Rights and Changes to Consent

These communications terms supplement the burial-right and website terms. They do not change burial-right eligibility, purchase limits, payment requirements, succession rules, or district approval procedures.

Changes to this page do not expand existing communications consent. The district will obtain new consent when required for a new communication purpose or method.
