Fees
The District may charge fees authorized by Idaho Code § 74-102. Except for fees separately authorized or prescribed by Idaho law, Idaho residents will not be charged for the first two hours of labor or the first 100 pages of paper copies.
Different fee provisions may apply to nonresidents. Fees will comply with applicable statutory limits and will be itemized. Advance payment may be required, and any payment exceeding actual authorized costs will be refunded.
An Idaho resident who demonstrates all three conditions in Idaho Code § 74-102(10)(f) qualifies for a fee waiver.
Records withheld or redacted
Some records or portions of records are exempt from disclosure. The District will provide nonexempt portions when required by law.
If a request is denied in whole or in part, the District will provide written notice identifying the statutory basis, the required statement concerning attorney review or consultation, and the requester’s right to challenge the denial and applicable deadline.
Under Idaho Code § 74-115, a requester may seek relief in the district court of the county where the records or some portion of them are located. A petition challenging a written denial or partial denial must be filed within 180 calendar days from the mailing date of the notice.
